Glossaries of claim terms should be mandatory in all patent applications. When a patent examiner initially reviews a patent claim he or she must find support for every claim limitation in the specification. Why not make an alphabetical list of every term and make it easy on the patent examiner? Glossaries allow the patent attorney to easily define exactly what is meant by a term so it serves the inventor as well.
When the patent is enforced in a litigation, the meaning and construction of the patent claims are left up to the judge who holds a “Markman Hearing.” Many cases are settled on the basis of the judge’s findings and hundreds of thousands of dollars in legal fees may be spent arguing what a patent claim term really means. Why not save the inventor this money by unambiguously defining the term in the glossary?
