Means Plus Function (patent claims)

Smith Hopen Intellectual Property Term Glossary Definition for Means Plus Function (patent claims)
A means-plus-function claim limitation recites a term and associated function language.  This is permitted under 35 USC 112, 6th paragraph.  The claim limitation is presumed to invoke Section 6 when it explicitedly uses the phrase "means for" or "step for" and includes functional language.  That presumption is overcome when the limitation further includes the structure necessary to perform the recitated function.l
