The Madrid Protocol

The Madrid system for the international registration of marks (the Madrid system) established in 1891 functions under the Madrid Agreement (1891), and the Madrid Protocol (1989). It is administered by the International Bureau of WIPO located in Geneva, Switzerland.

What countries are members of the Madrid Protocol?

As of November 2003, 61 countries have joined the Madrid Protocol. These countries are called "Contracting Parties." A current list of the Contracting Parties is available online at the World Intellectual Property Organization (WIPO) website: http://www.wipo.int/madrid/en.

Costs for Madrid Protocol Filing

  • Flat legal fee for initiating Madrid filing: $3,600
  • Advance on costs for each country designated – to be placed in trust: $620
  • Government fees billed at cost.
  • Post-filing prosecution billed at hourly rates.


FOREIGN ASSOCIATES AND INTERNATIONAL APPLICATIONS

We frequently administer the foreign filing of patents and trademarks through various international treaties.  In doing so, we retain the services of foreign attorneys in the appropriate jurisdictions.  Coordinating the administration, docketing and communication to foreign counsel is procedurally complex and demanding.  All members of our paralegal staff have attended seminars in Washington D.C. on international treaty procedures and filings.  We also conduct ongoing education within the firm to maintain this proficiency and to stay current with changes in the law.

Our firm is responsible for handling the docketing, communication and instructions to foreign counsel. Time expended on administering foreign matters is billed primarily at paralegal hourly rates.

 

* All members of the firm are registered to practice before the U.S. Patent & Trademark Office (USPTO).  All associates of the firm are either registered or practice before the USPTO or eligable for such registration.
